Those co-workers’s interview are required.
Since the 5th of March 2014 law, every employee get a professional interview with his employer every two years. This law decrees that the employee should have received either a training course intent, an accreditation of prior experiential learning (APEL), or a salary raise if not a promotion in the last six years.
In the companies with at least 50 employees, all the co-workers that didn’t get neither a professional interview nor three of the listed measures, will get their professional training course account stocked with 3000 Euros from the employer. The requirement of doing a professional interview to make an assessment every 6 years can be a very expensive financial penalty for the company. However, those rules have changed since the 1st of January 2019. Actually, adjustments are possible through a collective labor agreement. Only the frequency of the professional interviews and the assessment form of the career history are concerned. In order that companies who respected the 2014 law won’t be punished, a passing period was arranged. Until the 31st of December 2020, employers will not have to stock the employees’s training course account if they had neither a professional interview nor a training course follow-up, but at least an APEL, a salary raise or a professional improvement until.
A professional interview is a career history inventory of the employee, of his qualifications, his course, and his internal or external mobility (article L6315-1 from the labor legislation), reconciling the interest of both the company and the employee. The interview mustn’t be about the employee’s work evaluation in no instance. Not to be mistaken with the annual check-up which is a managerial matter. Since the 5th of March 2014 law, every employees have to resort to this professional interviews, every two years, no matter how big the company is.
